Terms of Service

Effective: October 22, 2025 · Please read these terms carefully before using Tomeo.

1) Acceptance of terms

By creating an account or using Tomeo, you agree to these Terms and to our Privacy Policy. If you are using Tomeo on behalf of an organization, you represent that you have authority to bind that organization.

2) Accounts & security

  • You are responsible for safeguarding your credentials and for activity under your account.
  • Provide accurate information and keep it up to date.
  • Notify us promptly of any unauthorized use or security incident.

3) Acceptable use

  • No illegal, infringing, or harmful content.
  • No attempts to disrupt, overload, or reverse engineer the service.
  • No unauthorized scraping or use of automated systems beyond documented APIs.

4) Intellectual property

Tomeo, the site, software, and related materials are owned by us and protected by IP laws. All trademarks, logos, and service marks are our property or that of our licensors.

5) Your content

You retain ownership of content you create in Tomeo. You grant us a limited license to host, process, and display that content as needed to operate the service (including background generation and exports) and to improve the service in accordance with our Privacy Policy.

6) Feedback

If you provide feedback or suggestions, you grant us a perpetual, irrevocable, royalty‑free license to use them without restriction.

7) Subscriptions, trials & billing

  • Paid plans bill in advance per the plan terms; taxes may apply.
  • Trials are for evaluation; we may modify or terminate a trial at any time.
  • You can cancel at any time; cancellations take effect at the end of the current billing period.
  • We use a third‑party payment processor and do not store full card numbers.

8) Suspension & termination

We may suspend or terminate your access for breach of these Terms or to protect the service and its users. You may stop using Tomeo at any time. Sections that by their nature should survive termination will survive.

9) Disclaimers

TOMEO IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.

10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER TOMEO NOR ITS SUPPLIERS WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL.

11) Indemnification

You agree to indemnify and hold Tomeo harmless from any claims, liabilities, damages, and expenses arising from your use of the service or violation of these Terms.

12) Governing law & venue

These Terms are governed by the laws of Ontario and the applicable laws of Canada. Courts located in Toronto, Ontario will have exclusive jurisdiction.

13) Changes to these terms

We may update these Terms from time to time. If changes are material, we will notify you via the app or email. Continued use constitutes acceptance of the revised Terms.
